The Fair Way Social is an online platform that connects golf enthusiasts ("Clients") with professional golfers ("Golfers") for playing experiences. We facilitate bookings, payments, and communications between Clients and Golfers but are not a party to the actual golf sessions.

3. User Accounts

3.1 Registration

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

• Client Accounts: For individuals seeking to book golf sessions with professionals
• Golfer Accounts: For verified professional golfers offering their services on the Platform

4. Golfer Verification

All Golfers must undergo a verification process before being listed on the Platform. This may include verification of professional credentials, competitive history, and background checks. We reserve the right to accept or reject any Golfer application at our sole discretion.

5. Bookings and Payments

5.1 Booking Process

Clients may submit booking requests to Golfers through the Platform. Golfers have the right to accept or decline any booking request. A booking is confirmed only when the Golfer accepts the request and payment is processed.

5.2 Payments

All payments are processed through our secure third-party payment provider (Stripe). By making a payment, you agree to their terms of service. The Platform charges a service fee on each transaction.

5.3 Golfer Payouts

Golfers receive payment after the completion of a session, minus the Platform's service fee. Payout timing and methods are subject to our payout policies.

6. Cancellation Policy

Our cancellation and refund policies are outlined in our Refund Policy. By using the Platform, you agree to abide by these policies.

7. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Harass, abuse, or harm another person
• Impersonate any person or entity
• Provide false or misleading information
• Interfere with the proper working of the Platform
• Attempt to circumvent the Platform to arrange services directly with Golfers
• Post or transmit any content that is offensive, defamatory, or inappropriate
• Use the Platform to advertise or solicit

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by The Fair Way Social and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Disclaimers

9.1 Platform Role

The Fair Way Social is a marketplace that connects Clients and Golfers. We are not responsible for the quality, safety, or legality of the services provided by Golfers.

9.2 No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FAIR WAY SOCIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Fair Way Social and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform or violation of these Terms.

12. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Platform or sending an email. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

14. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
